Introduction
JustMAIDit Company (Pty) Ltd provides an online platform which, amongst other services, allows users to register as independent service providers and provide their independent services to Clients who become users.
Users who want to enjoy the Cleaning Services will be bound by these terms and conditions in addition to JustMAIDit terms and conditions related to the use and access of the website.

 

Terms & Conditions
a) These terms and conditions (“Terms”) outline the rules for utilising the services offered through the ‘website’ [www.justmaidit.co.za] and the ‘JustMaidit mobile app’ (collectively referred to as the “Platform”), as well as the services provided on, or outside the Platform (referred to collectively as the “Services”).
b) The Terms also include our privacy policy available at [https://justmaidit.co.za/privacy], as well as any additional guidelines, terms, policies, and disclaimers that we may issue from time to time (“Supplemental Terms”). The Privacy Policy and Supplemental Terms are integral parts of these Terms. In the event of any conflict between these Terms and the Supplemental Terms regarding the applicable Services, the Supplemental Terms will take precedence. These Terms establish a legally binding contract between JustMAIDit Company (Pty) Ltd and its affiliates (referred to as “MAIDPro,” “we,” “us,” or “our”), and you, as a user of the Services or a legal entity booking Services on behalf of end-users (referred to as “you” or “User” or “Client”). By utilizing the Services, you confirm that you have the legal capacity and authority to agree to and be bound by these Terms. If you are representing another person or entity, you affirm that you possess the necessary authority to bind them to these Terms. Your use of the Services indicates your acknowledgement, understanding, and agreement to abide by these Terms, as amended periodically. These Terms override any previous written agreements. If you do not agree with these Terms or cannot comply with their provisions, please refrain from using the Services. “By submitting our webform or any kind of enquiry set by JustMAIDit Company while booking the Services, you agree to receive promotional calls and communications on the number shared, and such communication and SMS may be coming from a third-party platform.”

JustMAIDit is a “Platform”

a) The Website, telephonic, whatsapp and mobile app are a communications platform (“Platform”) for enabling the connection between individuals seeking to obtain cleaning services and/or individuals seeking to provide cleaning services we call them service providers or MAIDPro(s). The Company checks the background of service providers via third party background check services; however, the Company does not guarantee or warrant, and makes no representations regarding, the reliability, quality, or suitability of such service providers.
b) When interacting with service providers you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you do not know.

 

Company Services
a) MAIDPros are exclusively responsible for the services they provide, and any recourse regarding the domestic cleaning services lies with the MAIDPro(s). JustMAIDit and its affiliates do not employ.
b) The Platform is intended for personal, non-commercial use unless an alternate arrangement is agreed upon between you and JustMAIDit through a separate agreement.
c) Part of the Services involves sending you messages (via text, WhatsApp, the
application/platform, electronic mail, etc.) for various purposes, including relating to your bookings, subscriptions, and use of the Services, as well as for promotional and marketing strategies.
d) We have different types of services provided by our MAIDPros based on the size of the tasks booked. Stay-Out MAIDPros-: Are maids who do not stay with you but come in based on your booking. You may choose to have a full-time or permanent stay-out MAIDPro who provide services regularly based on your booking:
i) Full-time Stay-out MAIDPro – works full-time or everyday at your house but does goes back to their house at the end of the day. They have a normal working schedule, based on your needs you will determine their starting and finishing off time and their off days.
ii) Part-time Stay-out MAIDPros – Here is where a majority of our service providers are and their working is either 2hrs (Quarter-day); 4hrs(half-day); 8hrs(full-day) per booking.

e) Stay-In MAIDPros -: These are kind of maids that are dedicated to staying with you. There are many reasons people request a stay-in maid this maybe so because you have a little baby you need constant help with something, or you have a large family that needs extra pair of hands to help you cope. Because you travel a lot or you busy studying for a course, whatever the reason JustMAIDit will get the best fit for you.
With Stay-in maids you will need to provide accommodation and food for the MAIDPro who comes in to stay with you. Set your rules clear from the beginning so that your expectations are laid our clear, we can help you do that as well.

 

Selection of MAIDPros

a) You agree to treat Service Providers courteously and lawfully. You agree to provide a safe and appropriate working environment for Service Providers in compliance with all applicable laws and regulations and that you will provide reasonable co-operation to Service Providers to enable them to supply Services.
b) You agree to communicate any complaints to us and not the Service Provider. You agree to comply with our complaint and other policies on our website as may be varied from time to time.
c) You acknowledge that your nominated Service Provider may be unavailable from time to time e.g. through illness or vacation or leaving our service.
d) You agree that during the period of this agreement you will not book any services from, or engage, any Service Provider outside of our Website. You agree not to engage any Service Provider for 6 months after termination of this agreement.

 

Cancellation of the Cleaning Services

a) Clients seeking to cancel the Cleaning Services must provide the Service Provider and JustMAIDit with at least 48 hours’ notice.

b) If Clients fail to provide the requisite notice, Clients may be charged a pro-rata cancellation fee.

c) If a Service Provider arrives and the Client is not available at the selected premises, the Service Provider will wait one (1) hour prior to departing the premises. Should this occur, the Client will be charged the full Cleaning Fee and will not be able to recover any portion thereof.

 

Limited Liability for JustMAIDit

a) The parties hereby agree that neither JustMAIDit, nor any of its Directors or employees, will be held liable for any damages that result from: any information relied upon by the Client in selecting a Service Provider which subsequently transpires to be untrue. JustMAIDit acquires such information from third parties and accepts such information as what it purports to be and in doing so does not guarantee that such information is true and correct; any act by JustMAIDit, whether negligent or intentional, which causes damage to a Client’s or a third party’s property and/or possessions or which causes harm to a Client, a Client’s family member and/or a third party; the provision of services by any Service Provider in performing his or her services for a Client; and any perceived employment relationship between the Client and the Service Provider and any damage or liability that may arise from the termination thereof. By using the Services, you agree to hold the Company free from the responsibility for any liability or damage that might arise out of the transaction involved. Neither the company nor its affiliates or licensors is responsible for the conduct, whether online or offline, of any user of the Services. The Company and its affiliates and licensors will not be liable for any claim, injury or damage arising in connection with your use of the Services.

 

Consent to the Collection of Personal Information
a) Clients and Service Providers, in registering a profile on JustMAIDit online platform, thereby consent to the collection, use, processing, monitoring and dissemination of their personal information as defined by the Protection of Personal Information Act 4 of 2014 (“POPI”).
b) JustMAIDit will collect, use, and process Clients’ and Service Providers’ personal information for the defined purpose of providing the parties with access and use to the online platform through which Clients may secure the services of Service Providers and/or MAIDPros.

Account Creation

a) To access the Services, you must create an account on the Platform (“Account”). OR you can phone in or send an enquiry requests. During Account creation, you may need to provide certain information, including your address, household details, phone number and family size. You must be at least 18 years old to create an Account.
b) You warrant that the information you provide for your Account is accurate and truthful. You agree to promptly update your Account information if any changes occur.
c) You are responsible for safeguarding the security and confidentiality of your Account and must immediately notify us of any unauthorized use or disclosure of your Account or any security breach.
d) You are accountable for all activities that occur through your Account, including those carried out by individuals other than yourself. We are not responsible for unauthorized access to your Account.
e) By using the Services, you agree to receive communications from us, including payment requests, information about the Services, promotional offers, and notifications related to the Services.

User Content
a) The Platform may offer interactive features or services that allow users with accounts to post, upload, publish, display, transmit, or submit comments, reviews (including those about Service Providers and Services), suggestions, feedback, or other content (“User Content”).
b) For quality control and effective service provision, we may request reviews from you about Service Providers, and Service Providers may also provide reviews about you. Reviews must not contain knowingly false, inaccurate, or misleading information. Reviews serve various purposes, including quality control and assessing user suitability. We reserve the right to cancel, suspend, or terminate your registration if we determine, at our discretion, that you are not a suitable user.
c) By posting User Content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, transferable, sublicensable, and royalty-free license to use, publish, display, store, host, process, distribute, modify, adapt, translate, and create derivative works from the User Content. This license allows us to function and promote the Services and may involve advertising the Services or presenting evidence before a court or competent authority.
d) You waive any claims relating to moral rights or similar rights concerning the User Content, as outlined in this clause.
e) JustMAIDit may, without notice, remove or restrict access to User Content that violates these Terms or is deemed inappropriate at our sole discretion.

Consent to Use Data
a) By agreeing to these Terms, you also consent to the collection and use of your personal data in accordance with our Privacy Policy, available at [https://justmaidit.co.za/privacy]. The Privacy Policy explains the types of personal data we collect, how we process it, and your rights regarding your data.
b) In addition to the consent provided in the Privacy Policy, you also agree to the sharing of your information with our affiliates and other third parties. We may utilize your information for purposes such as providing the Services, analytics, trend analysis, targeted marketing, and enhancing the Services’ effectiveness and efficiency.
c) In compliance with applicable laws, we may be required to disclose your data to law enforcement agencies or government bodies in connection with criminal or civil proceedings.

User Conduct
(a) Discrimination against Service Providers based on various characteristics is prohibited.
(b) Service Providers must be treated with courtesy and respect, and a safe environment must be provided for them to perform their services. Service Providers may refuse service if an appropriate environment is not provided.
(c) Reporting any disrespectful, abusive, or inappropriate behavior of Service Providers is required within 48hours.

Booking A Service
a) You can book a service by means of the Platform.
b) To book a cleaning service, you will be required to complete an electronic registration form which will include the below and which will be used for the purpose of ensuring the service provider has the necessary detail in order to perform the service:
i. providing us with all the information we require, which may include (but not be limited to) a full name, valid email address, contact number and residential address; and
ii. confirming your acceptance of the Agreement and Privacy Policy, as read with such other terms (if any) which the Company may require you to accept.

Cleaning Services
a) In addition to registering a Profile on the Website, Service Providers must successfully complete and sign the Independent Contractor’s Agreement with JustMAIDit, before they qualify to be a MAIDpro and having their Cleaning Services being made available.
b) Mere application to become a MAIDpro with JustMAIDit does not guarantee that the Service Providers will indeed have their Cleaning Services advertised on the Website or get jobs right away.
c) Once registered as a user, Clients will have the option to select a MAIDpro from the available service providers.
d) Clients will be asked to enter the dates on which they require the MAIDpro and the hours for which they require the MAIDpro.
e) Clients will then receive confirmation of the fees payable for the MAIDpro services (“the Cleaning Fee”).
f) Unlike with Contractor Services, JustMAIDit will collect this Cleaning Fee directly from the Client and via the JustMAIDit website will then on pay the MAIDpro.
g) The Client will then receive the contact details and information of the booked MAIDpro for logistical purposes.

Payment Terms
a) Any fees which the Company may charge you for the Services are due prior to your cleaning service date in order to confirm an appointment for your cleaning and are non-refundable. This no refund policy shall apply at all times regardless of your decision to terminate your usage, the Company’s decision to terminate your usage, disruption caused to our Platform either planned, accidental or intentional, or any reason whatsoever.
b) The Company reserves the right to determine final prevailing pricing – Please note the pricing information published on the Platform may not reflect the prevailing pricing. However, the final prevailing pricing shall not exceed the estimated prices by more than ten percent(10%).
c) The Company shall indicate the following at a minimum:
i. the estimated total for the booking, offered prior to acceptance and confirmation of a booking. This estimate is based on a number of factors including, the day of the week, number of hours booked as well as the current demand and supply within the client’s area.
ii. penalties applicable in the provision of the product, service or transaction; should a user cancel a booking after 12:00 the day before, the user will be charged a cancellation fee. This cancellation fee includes JustMAIDit’s administrative fee and the Service Provider’s transport and/or lost earnings as applicable and as stated on our Website and booking confirmation email.
d) The Company, at its sole discretion, may make promotional offers with different features and different rates. These promotional offers, unless made to you, shall have no bearing whatsoever on your offer or contract. The Company may change the fees for our Services as we deem necessary for our business. We encourage you to check back at our Website periodically if you are interested about how we charge for the Services.

Use of the Service
a) Where we describe a Service Provider as “vetted” or similar, we are promising only that we have carried out certain checks which are specified on our Website when you make a booking and that those checks did not reveal any cause for concern. You acknowledge that in carrying out these checks we are reliant on information supplied by third parties. We cannot guarantee that the information is accurate nor can we guarantee that the Service Providers are otherwise suitable for your purposes. You use Service Providers at your own risk.
Supply of the Services:
a) Your order is an offer that is only accepted when we send you an email on behalf of one of your selected Service Providers confirming your order.
b) You agree to treat Service Providers courteously and lawfully. You agree to provide a safe and appropriate working environment for Service Providers in compliance with all applicable laws and regulations in South Africa and that you will provide reasonable co-operation to Service Providers to enable them to supply Services.
c) You agree to communicate any complaints to us and not the Service Provider. You agree to comply with our complaint and other policies on our Website as may be varied from time to time.
d) You acknowledge that your nominated Service Provider may be unavailable from time to time e.g. through illness or vacation or leaving our service.
e) You agree that during the period of this Agreement you will not book any services from, or engage, any Service Provider outside of our Platform to provide the Services. You agree not to engage any Service Provider for 6 months after termination of this agreement.
Payment for Services / Cancellation by You:
a) You must maintain a valid cheque / credit card registered on our Platform. You must ensure that all contact and payment information (eg email address, physical addresses, cheque / credit card numbers) which you provide is accurate and not misleading and that you will update it so that it remains so.
b) Prices include any applicable VAT or other sales tax unless otherwise stated.
c) Upon booking, the Company will reserve the estimated booking amount on your active cheque / credit card/ direct debit. Once the cleaning has been completed, the full actual amount due for the booking appointment will be debited from your active cheque / credit card. For repeat bookings (“Repeat Booking”), you authorise us to charge your cheque / credit card after the scheduled end-time for the visit.
d) We may at any time change the prices. We will give you notice by email at least one month before any price change takes effect. If you do not accept the new fee, you should cancel this Agreement as explained below. Otherwise the Services supplied after the expiry of the one month’s notice will be at the new price.
e) You can at any time cancel any individual visit, a Repeat Booking or this Agreement as a whole via the Platform or by contacting us. There is no charge if you cancel the appointment before the cut-off time of 12h00, the day before the appointment start time for the Service Provider visit. If so, you will not be charged for the cleaning appointment. If you cancel after the cut-off time of 12h00, the day before the appointment start time, then we will charge JustMAIDit’s administrative and Service Provider’s transport and/or lost earnings fees as applicable and as stated on our Website and booking confirmation email. This will happen by debit from your cheque / credit card and you authorise us to charge your card accordingly.
f) If the Service Provider does not show up for the appointment on the scheduled date and you notify us via our Platform within 24 hours after the scheduled start time, then we will at your option provide either a full refund of any payment made for that visit or else use reasonable endeavors to re-arrange the visit. We reserve the right not to make a refund or re-arrange a visit if we are not notified within that 24-hour period.
If any amount due by you is unpaid, we may:
a) charge reasonable additional administration costs; and/or
b) charge interest (0.9% per month on a rolling basis as per the Usury Act no. 73 of 1968) and pursue legal action against you; and/or
c) arrange for the supply of Services to be suspended; and/or
d) cancel this Agreement on written notice (including email).

Cancellation by us:
a) We may at any time without cause cancel any particular booking or this Agreement as a whole including your right to use our Platform, giving notice by email to the extent reasonably practicable. If so, we will refund any amounts paid by you for outstanding paid for cleaning appointments or any cleaning appointment scheduled to be performed after the date of cancellation.
Following cancellation of this Agreement:
Accrued rights and liabilities are unaffected. All clauses in this Agreement which are stated or intended to continue after cancellation will continue to apply. You must not attempt to re-register for or continue to use our Platform if we have given you notice of cancellation your content.
Your Content:
a) You are responsible for any content you post to the Website or Platform (“Your Content”).
b) Any of Your Content which you publish or send via the Website or Platform (including links or references to other content) must not be threatening, harassing, invasive of privacy, defamatory, offensive, racist, hateful, discriminatory or abusive or which we otherwise consider to be inappropriate.
c) If you post a review, you also promise that it is your independent, honest, genuine opinion.
d) You warrant that you have (and will retain) all rights and permissions needed to enable us to use Your Content as contemplated by the Platform and this Agreement.
e) We reserve the right without notice or refund to suspend, alter, remove or delete Your Content or to disclose to the relevant authorities any of Your Content or behaviour if it is the subject of complaint or where we have reason to believe that it breaches any term of this Agreement, or that such steps are necessary to protect the Company or others, or that a criminal act has been committed, or if we are required to do so by law or appropriate authority. If so, you must not attempt to re-publish or re-send the relevant content.
f) We do not accept responsibility if Your Content is misused by other users as this is outside our reasonable control.
g) We reserve the right to irretrievably delete Your Content at any time.
Social Media:
a) We reserve the right to remove any comments from our paid adverts on any social media sites.
b) All winners for social media competitions are chosen at our discretion.
c) We try our best to reply to any queries on our social media sites as quickly as possible between 7am and 7pm (GMT +2).
Content of other users:
We do not endorse or recommend any reviews by other users. You rely on such information at your own risk. We accept no legal responsibility for the accuracy of, or otherwise in relation to, any such reviews.
Placement Fee:
Should you at any stage make an appointment with a Service Provider outside of booking said appointment via JustMAIDit platform, you will be liable to pay JustMAIDit a placement fee reckoned at R1400, this placement fee shall be payable within 10 (ten) working days of his/her appointment with you. No termination of the appointment or variation of its terms will entitle you to any repayment of the placement fee. This clause will survive the termination of this agreement and will apply for 6 (six) months after its termination.
Employment and Tax
JustMAIDit is not an employment service and does not serve as an employer of any User or Service Provider. As such, JustMAIDit will not be liable for any tax or withholding, including but not limited to unemployment insurance, employer’s liability, social security or payroll withholding tax in connection with the use of these Services. You understand and agree that if JustMAIDit is found to be liable for any tax or withholding tax in connection with these Services, then the Service Provider will immediately reimburse and pay to JustMAIDit an equivalent amount, including any interest or penalties thereon.

 

YOUR RESPONSIBILITIES
(a) Accuracy of Information: You declare and confirm that all information provided by you in connection with the Services and Service Provider is accurate, complete, and true at the time of agreeing to these Terms. You agree to ensure the continued accuracy and truthfulness of this information throughout your use of the Services. In the event of any changes to the provided information during the term of these Terms, you undertake to promptly notify us of such changes. We shall not be held responsible or liable for any losses or damages you may incur due to incorrect, incomplete, inaccurate, or misleading information, documentation, material, or data provided by you.
(b) Cooperation in Legal Proceedings: You shall extend your full cooperation to us in the event of any legal proceedings initiated against us due to a breach of your obligations or covenants under these Terms. You agree to assist us in our defence and take necessary actions to protect our interests.
(c) User Content Representations:
(i) You represent and warrant that you possess all necessary intellectual property rights or permissions to provide User Content and grant the licenses as outlined in these Terms.
(ii) You are solely responsible for all activities conducted through your Platform account and all User Content you submit.
(iii) Your User Content does not infringe any obligations or responsibilities under other agreements.
(iv) Your User Content does not violate or infringe upon any intellectual property or proprietary rights, including rights of publicity or privacy, of any person or entity.
(v) Your User Content is free from harmful components such as viruses, corrupted data, or destructive files.
(vi) Your User Content does not contain false, misleading, defamatory, harmful, offensive, obscene, pornographic, discriminatory, or otherwise objectionable material.
(vii) Your User Content complies with all legal and ethical standards and does not violate any third-party rights.

(d) Responsible Use of Services:
You shall use the Services solely in accordance with these Terms. Specifically, you shall not:
i. Infringe upon any intellectual property rights, including copyrights, patents, trademarks, or trade secrets of any party.
ii. Copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, create derivative works from, or license the Services, except as permitted under these Terms.
iii. Transmit data containing viruses, malware, or other harmful code designed to disrupt computer software or hardware.
iv. Use any automated methods to monitor, copy, or interact with the Services.
v. Systematically retrieve content from the Services to compile databases, directories, or other collections.
vi. Engage in unlawful, fraudulent, malicious, or inconsistent activities with these Terms.
vii. Attempt to gain unauthorized access to the Services or our systems.
viii. Violate applicable laws in any manner.
ix. Interfere with or disrupt the functioning of the Services.
(e) Safe and Respectful Treatment of Service Providers: You shall treat Helpers with courtesy, and respect, and provide a safe environment for them to perform their services. Service Providers have the right to refuse service if suitable conditions are not provided.
(f) Reporting Inappropriate Behavior: You are obligated to report any disrespectful, abusive, or inappropriate behaviour of Service Providers within 48 hours of the incident.
(g) Non-Solicitation of Service Providers: You shall not directly or indirectly solicit, influence, approach, or engage Service Providers you have availed services from to terminate their registration or engagement with the Platform. You acknowledge that this limitation is necessary to protect the privacy and security of Service Providers and does not restrict your ability to obtain similar services through the Platform or other means.

11. OUR INTELLECTUAL PROPERTY
(a) Ownership of Services: All rights, titles, and interests in the Services, including associated intellectual property rights, are owned by us or licensed to us. Subject to compliance with these Terms, we grant you a limited, non-transferable, non-sublicensable, and revocable license to use the Services in accordance with these Terms and any instructions provided by us. No rights beyond those expressly granted herein are conferred.
(b) Feedback Usage: You may provide suggestions and feedback (“Feedback”) to us. We may use, copy, disclose, publish, display, distribute, and exploit the Feedback without any obligation of royalty, acknowledgement, or consent.
(c) Intellectual Property Limitation: Except as expressly stated in these Terms, nothing herein confers any right or license to use our or any third party’s intellectual property rights.
Non- discrimination
In the performance of this Agreement, the Client agrees that they shall not engage nor employ any unlawful discriminatory practices in their engagement and access to the JustMAIDit App or with engagement with the MAIDPros or JustMAIDit, in any other respect, on the basis of race, religious creed, colour, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, gender, gender identity, gender expression, age, or sexual orientation.

Consumer Protection
If this Agreement and/or any Content and/or Services provided and/or made available on the Website or Software are regulated by or subject to the Consumer Protection Act 68 of 2008, as may be amended from time to time (the “CPA”), it is not intended that any provision of this Agreement contravene any provision of the CPA. Therefore all provisions of this Agreement must be treated as being qualified, to the extent necessary, to ensure that the provisions of the CPA are complied with.
No provision of this Agreement (or any contract governed by this Agreement):
a. does or purports to limit or exempt us from any liability (including, without limitation, for any loss directly or indirectly attributable to our gross negligence or wilful default or that of any other person acting for or controlled by us) to the extent that the law does not allow such a limitation or exemption;
b. requires you to assume risk or liability for the kind of liability or loss, to the extent that the law does not allow such an assumption of risk or liability; or
c. limits or excludes any warranties or obligations which are implied into this Agreement (or any contract governed by this Agreement) by the CPA (to the extent applicable) or which we give under the CPA (to the extent applicable), to the extent that the law does not allow them to be limited or excluded.

12. TERM AND TERMINATION
(a) Duration of Terms: These Terms remain effective unless terminated as specified herein.
(b) Our Right to Terminate: We may restrict, deactivate, or terminate your access to the Services:
(i) Immediately if you breach these Terms or fail to meet the standards required to use the Services.
(ii) Immediately for other legitimate reasons or due to legal or regulatory requirements.
(c) Termination by You: You may terminate the Services by notifying us via email at
support@JustMaidit.co.za
(d) Effects of Termination: Upon termination, your account expires and access to the Services is restricted.

13. DISCLAIMERS AND WARRANTIES
(a) Service “As Is”: The Services are provided “as is” without warranties of any kind. We do not guarantee that the Services will meet your expectations or requirements.
(b) Disclaimer of Service Providers: While we strive to provide accurate Helper service information, we make no warranties about the quality, reliability, or accuracy of the Helper services. We are not liable for services, their performance, or any damage caused by Service Providers. Booking Service Providers’ services establishes a direct contract between you and the Service Providers.
(c) User Assumes Risk: Your use of the Services and Service Providers is at your own risk. We are not responsible for any consequences arising from your use of the Services.
(d) Limitation of Liability: JustMAIDit is not liable for any loss or damage arising from the Services. We are not liable for any indirect, incidental, consequential, or exemplary damages due to the Services or Service Providers.

14. INDEMNITY
You agree to indemnify and hold us harmless from any claims, demands, losses, liabilities, damages, costs, and expenses arising from your use of the Services, violation of these Terms, or any breach by third parties using your account.

15. JURISDICTION, GOVERNING LAWS, AND DISPUTE RESOLUTION
This Platform is controlled, operated and administered by the Company from its offices within the Republic of South Africa. Access to the Platform from territories or countries where the content or purchase of the Services sold on the Website is illegal is prohibited. You may not use this Platform in violation of South African laws and regulations. If you access this Platform from locations outside of South Africa, you are responsible for compliance with all local laws. This Agreement shall be governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the Johannesburg High Court in the event of any dispute. If any of the provisions of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible to give effect to the intent of this Agreement, and the remainder of this Agreement shall continue in full force and effect. This Agreement constitutes the entire agreement between you and the Company regarding the use of the Services, Platform.

16. GRIEVANCE REDRESSAL
a) INFORMAL NEGOTIATIONS. To expedite resolution and reduce the cost of any dispute, controversy or claim related to this Agreement (“Dispute”), you and the Company agree to first attempt to negotiate any Dispute (except those Disputes expressly excluded below) informally for at least thirty (30) days before initiating any arbitration or court proceeding. Such informal negotiations will commence upon written notice, as set forth above.
b) Save for urgent or interim relief which may be granted by a competent court, in the event of any dispute of any nature whatsoever arising between you and JustMAIDit on any matter provided for in, or arising out of these T&C, and not resolved through the Customer Care Department of JustMAIDit, then such a dispute shall be submitted to confidential arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa.
c) WAIVER OF RIGHT TO BE A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. You and the Company agree that any arbitration will be limited to the Dispute between the Company and you individually. You acknowledge and agree that you and the company are each waiving the right to participate as a plaintiff or class member in any purported class action or representative proceeding. Further, unless both you and the Company otherwise agree, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this “Dispute Resolution” Section will be deemed null and void.

17. MISCELLANEOUS PROVISIONS
(a) Changes to Terms: These Terms may be revised at any time, and changes are effective immediately upon posting. Continued use of the Platform implies acceptance of changes.
(b) Modification of Services: We reserve the right to modify or discontinue the Services at any time.
(c) Severability: If any provision is unenforceable, the remainder of the Terms remains valid.
(d) Assignment: You may not transfer your rights without our consent. We may assign our rights.
(e) Notices: Official notices should be sent to support@Justmaidit.co.za.
(f) Third Party Rights: No third party has rights under these Terms.
(g) Force Majeure: We are not liable for events beyond our control.
